How can my brother go to college if....?

On my brothers educational records he has my fathers last name. On his birth certificate it is under my mothers last name so for example Victor Rodriguez at school but legally he is Victor Sanchez basically my parents messed up and have a mess here but can my brother still go to college since they ask for your doents and his name wont match his school record to his legal records? if he cant go to college like this what are some things we can do to set things straight and fix this situation about his name.
